1. Introduction & Agreement

Welcome to Hostursite.com. These Terms of Service (this “Agreement” or “Terms”) govern your purchase and use of all services (“Services”) offered by Hostursite.com, as described on our website.

By creating an account, ordering, or using our Services, you (“Client”, “you”, “your”) agree to be bound by all terms and conditions of this Agreement. You also agree to be bound by the terms of our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not use our Services.

2. Services Offered

Hostursite.com provides a range of services, including:

• Web Hosting: Shared Hosting (Basic, Advance, Cloud), Virtual Private Servers (VPS), and Dedicated Servers.

• Domain Services: Domain name registration, transfer, renewal, and DNS management.

• Storage Solutions: Object Storage and related backup solutions.

• Security Services: SSL Certificates and other security measures.

We reserve the right to modify, suspend, or discontinue any aspect of the Services, including pricing and feature availability, at any time, with or without notice.

3. Account Registration & Eligibility

• Eligibility: To use our Services, you must be at least 18 years old and capable of entering into a legally binding contract.

• Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep this information updated.

• Account Security: You are solely responsible for maintaining the confidentiality of your account login credentials (username and password). You are also responsible for all activities that occur under your account, whether authorized by you or not.

• Account Misuse: We reserve the right to suspend or terminate any account involved in fraud, abuse, or any violation of these Terms.

4. Acceptable Use Policy (AUP)

You are strictly prohibited from using our Services for any unlawful, harmful, or abusive purpose. This includes, but is not limited to:

• Illegal Content: Hosting, distributing, or linking to any content that violates the laws of Bangladesh or any other applicable jurisdiction. This includes, but is not limited to, copyrighted material you do not own, child pornography, or fraudulent schemes.

• Malicious Activities: Transmitting malware, viruses, or spyware. Engaging in phishing, spamming (unsolicited commercial email), or running botnets.

• Network Abuse: Launching Denial of Service (DDoS) attacks, port scanning, or any script/program that disrupts or harms our network or other clients.

• Prohibited Content: Hosting or promoting content related to adult/pornographic materials, extreme violence, hate speech, terrorism, or discrimination.

• System Abuse: Attempting to gain unauthorized access to any system or network.

Violation of this AUP may result in immediate account suspension or termination without refund.

5. Resource Usage, Prohibited Use, and Fair Use Policy (FUP)

5.1. Fair Use Policy (FUP) – Resource Limits

This FUP ensures the stability and fairness of our shared infrastructure. Sustained utilization of resources above the limits specified below is a violation of this Agreement and may lead to throttling or suspension.

5.2. Prohibited High-Risk Use

You must not use Hostursite.com services for any system where failure or interruption could directly result in loss of life, personal injury, severe physical or environmental damage. Examples include life-support systems, military command, or critical transport systems.

6. Payments, Billing, and Renewals

• Billing: All services are billed in advance (e.g., monthly, quarterly, annually) according to the rates listed on our website.

• Payment: Timely payment is required to maintain your Services. Accepted payment methods are listed on our website.

• Automatic Renewal: To ensure uninterrupted service, most services will automatically renew at the end of their billing cycle. You are responsible for disabling auto-renewal if you wish to cancel.

• Late Payments & Grace Period: Failure to pay on time will lead to the suspension of your Services.

  • Shared Hosting (Basic, Advance, Cloud): We provide a 5-day grace period after your due date. If payment is not received within these 5 days, your service will be suspended. If payment is not received after 10 days from the due date, your account will be terminated, and all data will be permanently deleted.

  • VPS & Dedicated Servers: There is no grace period for VPS or Dedicated Server payments. Services will be suspended immediately on the due date if payment is not received, and may be terminated shortly thereafter.

• Price Changes: We reserve the right to change our prices at any time. We will provide you with at least 30 days’ notice of any price changes for services you are actively subscribed to.

7. Refund Policy & Money-Back Guarantee

• Shared Hosting (30-Day Guarantee): We offer a 30-day money-back guarantee on new Shared Hosting plans (Basic, Advance, Cloud). This guarantee applies to new clients on their first order.

• Non-Refundable Services: There is no money-back guarantee or refund for the following services under any circumstances:

  • Any service billed on a monthly cycle (including monthly Shared Hosting plans).

  • VPS Servers (regardless of billing cycle).

  • Dedicated Servers (regardless of billing cycle).

  • Domain Name Registration, renewals, or transfers.

  • SSL Certificates.

  • Any other software license or third-party add-on.

• Violation of Terms: No refunds will be issued to any Client whose account is suspended or terminated for violating this Agreement, including our AUP.

8. Service-Specific Terms

8.1. Hosting (Shared, Cloud, VPS, Dedicated)

• Resource Usage (Shared/Cloud): All resource limits, including specific CPU, RAM, and Disk Usage restrictions, are defined and governed by the Fair Use Policy (FUP) detailed in Section 5.5 of this Agreement. Any violation of the FUP may result in the limitation or suspension of services.

• Prohibited Uses (Shared/Cloud): Shared hosting plans cannot be used for: Public file hosting, data storage/backups not directly related to the active website, or running game servers/mail servers.

• VPS/Dedicated Servers: You are responsible for all activity conducted on your server, including security, patches, and management, unless you have purchased a separate management service from us.

8.2. Domain Name Registration

• By registering a domain name with us, you acknowledge and agree to be bound by the policies of the Internet Corporation for Assigned Names and Numbers (ICANN), including their Uniform Domain Name Dispute Resolution Policy (UDRP).

• You also agree to the terms and conditions of the specific top-level domain (TLD) registrar (e.g., .com, .net, .bd) that we use to procure the domain on your behalf. These terms are passed through to you.

• All domain registrations are non-refundable.

8.3. Object Storage

• Our Object Storage service is intended for storing and serving live, accessible data.

• It is not intended for “cold storage,” archival, or long-term backup purposes unless specified by your plan.

• You will be billed for storage space and bandwidth (data transfer) as per the terms of your specific Object Storage plan.

9. Backups and Data Loss

Your data is your responsibility. You are solely responsible for maintaining your own regular, independent backups of all your website data, databases, and emails.

We provide courtesy backups for certain plans, but these are not guaranteed and are provided “as-is.” Our backup policy is as follows:

• Shared Hosting (Basic): No complimentary backups are provided. You are 100% responsible for your own backups.

• Shared Hosting (Advance): We provide a 3-day, 1-layer courtesy backup.

• Shared Hosting (Cloud): We provide a 5-day, 2-layer courtesy backup.

These courtesy backups are for our operational and disaster recovery purposes. Hostursite.com is not liable for any data loss, corruption, or hardware failure, regardless of the cause. We strongly recommend you maintain your own off-site backup copies.

10. Service Availability (Uptime)

We target a 99.9% network uptime for our Services. This target does not include downtime resulting from:

• Scheduled maintenance (we will attempt to provide advance notice).

• Client-side errors, script failures, or application failures.

• Circumstances beyond our control (e.g., force majeure, DDoS attacks, upstream network outages).

We do not offer service credits for downtime unless specified in a separate Service Level Agreement (SLA) for a specific high-tier service.

11. Suspension and Termination

We reserve the right to suspend or terminate your Services immediately and without notice if:

• You violate any provision of these Terms or our AUP.

• You fail to pay for your Services on time.

• Your service is found to be hosting illegal or “High-Risk” content.

• Your service causes harm to our network or other clients.

Upon termination, all your data will be permanently deleted from our servers. We are not responsible for any data loss resulting from termination.

12. Limitation of Liability

To the fullest extent permitted by law, Hostursite.com (including its employees, directors, and partners) shall not be liable for any indirect, incidental, special, or consequential damages. This includes, but is not limited to, loss of profits, revenue, data, or goodwill.

Our total aggregate liability in any event shall be limited to the total fees you paid to us during the thirty (30) days immediately preceding the event giving rise to the claim.

All Services are provided “as is” and “as available” without any warranty of any kind.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hostursite.com, its employees, and affiliates from any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Services.

• Your violation of this Agreement.

• Any content or data you host.

14. Law Enforcement Cooperation

We will cooperate fully with authorized law enforcement agencies as required by law. If your hosted content or activity violates the law or poses a threat to public safety, we may suspend the service and share relevant data (logs, account information) with authorities.

15. Changes to Terms

We reserve the right to modify these Terms at any time. The revised version will be posted on our website with an updated effective date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

16. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Bangladesh.

Any dispute or claim arising out of this Agreement shall be resolved exclusively in the courts located in Dhaka, Bangladesh.

17. Entire Agreement

This Agreement, including the Privacy Policy incorporated by reference, constitutes the entire agreement between you and Hostursite.com and supersedes all prior and contemporaneous agreements, proposals, or representations.
